On November 12, 2025 the Court of Appeal for Ontario issued its decision regarding Ontario’s legal authority to offer international liquidity with jurisdictions beyond Canada.
The majority opinion, rendered in a 4-1 decision, affirmed this authority; however, many operational aspects of the Proposed Model remain undefined. Additionally, no timeline has been provided for when Ontario may initiate the model.
This marks a significant victory for Ontario, bringing back a valuable option for consumers who enjoy pooled gaming activities such as poker and Daily Fantasy Sports (DFS).We look forward to collaborating with the Province of Ontario, the Alcohol and Gaming Commission of Ontario, and iGaming Ontario as they begin implementing these changes.
While the Canadian Lottery Coalition (comprising of BCLC, Lotteries & Gaming Saskatchewan, Manitoba Liquor & Lotteries, and Atlantic Lottery) has 30 days to appeal the decision, we believe that the strength of the verdict will encourage a measured response.
