CGA Applies for Intervenor Status 

As some of you are aware the Attorney General of Ontario recently filed a reference question with the Ontario Court of Appeal to seek clarity on the issue of international liquidity (outside of Canada).

The Canadian Gaming Association (CGA) has filed for intervenor status to offer perspective on this matter. The CGA has previously held intervenor status (in 2019 in the Atlantic Lottery Corporation Inc. v. Babstock in support of the appellants, the Atlantic Lottery Corporation and its VLT and software suppliers and was represented by McCarthy Tétrault LLP).

Regarding the Ontario Court of Appeal reference question, five other applications were filed: two by CGA members Flutter Entertainment plc and NSUS Group Inc. (GG Poker), along with the Province of British Columbia, Mohawk Council of Kahnawa:ke, and what is known as the Canadian Lottery Coalition, comprised of BCLC, ALC, Manitoba Liquor & Lotteries and Lotteries & Gaming Saskatchewan.

The hearing to consider the applications of intervenors will be held on May 1st.  The consideration of the question by the court of appeal will be heard in late November.

We are pleased to support the Attorney General to ensure that the perspective of the Canadian gaming community is considered so that the court can release a principled decision that benefits the industry.
